Detroit’s City Code Sec. 5-15-7(4) states that “no patron shall knowingly or intentionally touch an employee who appears semi-nude on the premises of a sexually-oriented business.” Additionally, this applies to the employees of a sexually-oriented business as the Ordinance also states that “No employee who regularly appears semi-nude in a sexually-oriented business shall knowingly or intentionally touch a patron or the clothing of a patron on the premises of [the business].”

This results in numerous patrons and employees facing criminal liability as stated in Detroit’s City Code Sec. 5-15-9(a): “A person, business, or entity violating or refusing to comply with any provision of this article shall, upon conviction, be deemed guilty of a misdemeanor and shall be punished by imposition of a fine not to exceed five hundred dollars ($500.00) or by imprisonment for a period not to exceed ninety (90) days, or both, in the discretion of the court.”
