In 2017, Malibu Media (X-Art) filed more than half of the 1,019 file-sharing cases in the United States. During the first month of 2018, three copyright holders filed a total of 286 lawsuits for copyright infringement and illegal downloading of the adult films. That’s three times more than the monthly average for 2017. Strike 3 Holdings has filed 133 lawsuits this year.

Why and How are Strike 3 Holdings suing me?

Strike 3 Holdings are suing you for unlawfully downloading or streaming of videos from their Blacked, Tushy, and Vixen adult websites and DVDs. Strike 3 Holdings, file federal copyright infringement lawsuits in Federal Court against multiple John Doe/unknown Defendants using known IP addresses.

These lawsuits are for illegal BitTorrent, a peer to peer file sharing system to distribute large amounts of data, downloading of pornography and peer to peer file sharing. BitTorrent works by breaking a file into small pieces that are then exchanged with other users. After all the pieces are downloaded, they automatically reassemble into the movie and then can be viewed.

The way these companies’ lawsuits works is a lawsuit is filed against a “John Doe” and an IP address. Then, a subpoena is issued to Comcast, Verizon, AT&T, or another Internet Service Provider (ISP) to provide your name and address. The ISP will then turn over your information to Strike 3’s lawyers. Strike 3 Holdings & The Law:

According to 17 U.S.C. § 504(a)(2), where there is a copyright infringement the Plaintiff can elect to receive statutory damages in lieu of actual damages. The most recent amendment to criminal copyright infringement was the No Electronic Theft Act of 1997 which has made it a felony to reproduce or distribute copies of copyrighted work electronically. Congress also enacted Title I of the Digital Millennium Copyright Act (DMCA) in 1997. The DMCA prohibits “circumventing a technological measure that effectively controls access to a work protected under this copyright title.” 17 U.S.C. § 1201(a)(1)(A). There are two types of copyright infringement acts, a commercial and non-commercial act. A commercially motivated infringement is subject to higher penalties. A commercially motivated infringement act can be penalized up to 5 years in federal prison and approximately $250,000 in fines whereas. A noncommercial act can receive one year of federal prison and $100,000 in fines.
